School Board Seeking Legal Advice About School Board Member

According to the The Eagle Tribune, on January 24, 2015, School Board member Ken Eyring sent a confidential email to William "Bill" O'Brien, a State Representative from Mount Vernon, NH. This issue was brought to the attention of the public at the March 17, 2015 School Board meeting by School Board member Dennis Senibaldi.

Mr. Senibaldi alleged that Mr. Eyring violated his oath of office by sharing confidential school documents.  If and why Mr. Eyring was communicating with a State Representative from another District about a Windham School Board issue remains unclear.

At a Special School Board meeting held on March 24, 2015, the question of Mr. Eyring’s conduct was raised. It was suggested that the School District attorney join the Board in a non-public “non-meeting” to determine if a breach of office occurred.  

It is the understanding of Windham LINK that this “non-meeting” will be held prior to the regularly scheduled School Board meeting on Tuesday, April 7, 2015.  Any actual discussion regarding the attorney’s advice and recommended next steps should then occur during the public part of the meeting.

I'm an attorney and have done significant research into RSA 91-A. Not only does the case law clear School Board member Ken Eyring, it HEAVILY supports his actions regarding his investigation of the Cenergistics contract.

CONFIDENTIAL INFORMATION WAS NOT DISCLOSED.

To the contrary, Mr. Eyring was compelled by his oath of office to look into this contract in order to protect our interests as taxpayers. If needed, I hope to make this clear at the next School Board Meeting. See you there.
